Supreme Court will hear chicago gun ban case

The supreme court said they would take up the case.

It basically will finally give a determination of whether the 2nd amendment extends to state/local gov laws and not just federal laws like chicago is claiming it does.  (i.e. the DC gun ban is a federal law cause DC isn't a state, so just cause the 2nd amendment prevailed on DC the decision didn't carry over to the other bans in the country).

It's gonna be like a year before they even have opening arguments though.

My guess on the decision is we will see the chicago gun ban go bye/bye.  The pro-ban logic here is that the 2nd amendment ins't extended to the state/local level.  Some of them actually aren't (5th amendment- indictment must be by grand jury).  But the 1st amendment was extended to the state/local level on the premise that it is an individual right and fundemental to liberty.

So if you apply that to the 2nd amendment i think you can say bye-bye ban, cause the DC gun ban case already said it was an individual right and the amendment itself say "being necessary to the security of a free State".  I guess we shall see. .........................

I'm all for seeing the second amendment enforced. Anybody that wants to own a gun has to be a member of a local militia. A well regulated militia. .........................

I actually like that idea, and as simple as it sounds. I don't think I've ever heard it. .........................

I never heard that suggested before either.  The problem then lies in what is actuall a militia? Does the gov get to decide that?

I always saw the first part of the 2nd amend as a rationale forthe second half.

Ie in today's language. A well regulated militia is Necessary to secury a free state, thus, The right of the people to keep and bear arms should not be infringed. .........................

Looks like the Chicago gun ban will be overturned

seems like chicagos attorney was arguing why guns should be regulated in general instead of why the second amendment should not be extended to the states and the judges didn't seem to like that since they just ruled on that a few years ago.

now we will see if gun violence goes down in Chicago. .........................

I think it depends how accessible they make guns. I wouldn't be surprised to see them institute some ridiculous license in that state to own a gun... .........................

or some crazy regulation like DC did when it was overturned.

apparently before DC just outright banned handguns you were required to have a seperate handgun permit for each room in your house otherwise, by law you were not allowed to bring your gun into that room.

Overturned

and they extended the 2nd Amendment to the States because:

""It cannot be doubted that the right to bear arms was regarded as a substantive guarantee, not a prohibition that could be ignored so long as states legislated in an evenhanded manner," wrote Justice Samuel Alito."

Seems logical enough to me.

Can't wait for the constant video of Daly talking about duels in the streets and little kids using guns as play toys.... .........................
